By accessing our website, submitting an inquiry, entering a promotion, or booking travel through Waterful Travel, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Seller of Travel Registration

Waterful Travel is a California corporation and a registered California Seller of Travel (Registration No. 2169126-50). Registration as a Seller of Travel does not constitute approval by the State of California.

Waterful Travel maintains a consumer protection bond as required by California law.

Waterful Travel is the registered Seller of Travel for all travel experiences promoted under its brands, including but not limited to Seavyre, Twin Cruise, and other Waterful Travel experiences.

Role as Intermediary

Waterful Travel acts solely as an intermediary between travelers and third-party suppliers, including but not limited to cruise lines, hotels, transportation providers, venues, entertainers, and tour operators.

We do not own, operate, manage, control, or supervise any third-party services.

All bookings are subject to the terms and conditions of the applicable supplier.

Supplier Contract Incorporation

All supplier agreements, including cruise line passenger ticket contracts, airline terms, hotel policies, tour operator agreements, and venue terms, are incorporated by reference into these Terms.

In the event of conflict, supplier contracts control with respect to services they provide.

Independent Contractors

Waterful Travel may engage independent contractors, consultants, event producers, entertainers, and marketing partners.

Such individuals are independent contractors and not employees or agents of Waterful Travel.

Waterful Travel is not responsible for their acts, omissions, or representations.

Booking & Payment Terms

All bookings are subject to availability and supplier confirmation.

Deposits and final payments are governed by supplier policies and may be non-refundable.

Planning fees, service fees, and event coordination fees charged by Waterful Travel are non-refundable unless expressly stated in writing.

Payment of any invoice constitutes acceptance of these Terms and all applicable supplier terms.

Unauthorized chargebacks or payment reversals constitute breach of contract.

Group Booking Responsibility

If you book on behalf of others, you represent that you have authority to do so and agree to communicate these Terms to all members of your party.

You accept responsibility for payment defaults, damages, or misconduct by members of your booking group.

Cancellations, Changes & Refunds

Cancellation penalties vary by supplier and event structure.

Waterful Travel does not control supplier refund timelines or financial stability.

Failure to meet travel documentation, entry, or health requirements does not entitle you to a refund.

Any changes to an existing booking may result in a service fee of up to $150 per change, in addition to any applicable supplier-imposed fees or fare differences.

Health Protocols, Itinerary Changes & Force Majeure

Travel suppliers and government authorities may impose:

• Health requirements
• Testing mandates
• Quarantine rules
• Vaccination requirements
• Isolation protocols
• Itinerary changes

In such cases, no refunds or credits shall be issued by Waterful Travel.

Waterful Travel is not liable for disruptions caused by:

• Acts of God
• Weather events
• Public health emergencies
• Government actions
• Mechanical failures
• Labor disputes
• Supplier insolvency

Travelers voluntarily assume all risks associated with travel.

Travel Insurance & Risk Allocation

Travel insurance is strongly recommended.

Waterful Travel may provide information regarding insurance options but does not guarantee coverage or claims approval.

Waterful Travel maintains commercially reasonable business insurance appropriate to its operations.

Travel suppliers maintain independent insurance coverage.

Participants are responsible for securing personal travel insurance.

Chargebacks & Payment Disputes

Unauthorized chargebacks, reversed payments, or fraudulent disputes after confirmation of services constitute breach of these Terms.

Waterful Travel reserves the right to recover administrative costs, merchant processing fees, collection costs, attorneys’ fees, and damages.

No Professional Advice

Waterful Travel does not provide medical, legal, tax, financial, or safety advice.

Travelers are responsible for consulting qualified professionals regarding personal matters.

Photography, Media & Likeness Release

By participating in any Waterful Travel experience, you grant Waterful Travel a perpetual, worldwide, royalty-free right to use your name, likeness, photographs, and recordings for marketing and promotional purposes without compensation.

User-Generated Content

By submitting or tagging content related to Waterful Travel experiences:

• You grant Waterful Travel a worldwide, perpetual, royalty-free license to use such content.
• You represent that you have authority to grant this license.
• We may remove unlawful or inappropriate content.

Contests, Promotions & Giveaways

Promotions may include complimentary travel accommodations.

Promotions:

• Are subject to official rules
• May be modified or canceled
• Are void where prohibited
• Require eligibility verification

Complimentary travel may still require payment of taxes, port fees, gratuities, airfare, and incidentals.

Awards are non-transferable and non-cash redeemable.

SMS Communications

By providing your mobile number and opting in, you consent to receive SMS communications regarding bookings and promotions.

Consent is not a condition of purchase.

Message frequency may vary. Standard carrier rates may apply.

You may opt out by replying STOP.

Affiliate & Influencer Disclosure

Waterful Travel may engage affiliates, ambassadors, or influencers who receive commissions or promotional benefits.

Statements made by affiliates reflect personal opinions and do not constitute guarantees by Waterful Travel.

Limitation of Liability

To the fullest extent permitted by law, Waterful Travel shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability shall not exceed the amount of fees paid directly to Waterful Travel.

Indemnification

You agree to indemnify and hold harmless Waterful Travel, its officers, directors, contractors, affiliates, and representatives from claims arising out of:

• Your conduct
• Your breach of these Terms
• Violation of supplier policies
• Negligent or unlawful acts

Dispute Resolution – Binding Arbitration

Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding arbitration in California.

You waive the right to trial by jury.

You waive the right to participate in class or collective actions.

Judgment on the arbitration award may be entered in any court having jurisdiction.

No Waiver

Failure to enforce any provision shall not constitute waiver.

Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

Assignment

Waterful Travel may assign its rights and obligations under these Terms without notice. You may not assign your rights without written consent.

Survival

Provisions relating to liability limitation, indemnification, arbitration, and intellectual property shall survive termination of services.

Modifications

Waterful Travel reserves the right to modify these Terms at any time. Continued use constitutes acceptance.
